Terms & Conditions – IgnisInfinity_Creative

These terms and conditions apply to all offers, quotations, and agreements of IgnisInfinity_Creative. Unless explicitly stated otherwise in the articles below, the General Terms and Conditions of DuPho (Dutch Photographers) also apply. The current DuPho terms can be downloaded from Algemene voorwaarden - Dutch Photographers (English version available) or requested from the photographer.

In case of conflict, the specific provisions of IgnisInfinity_Creative prevail.

1. Applicability and Age

• These terms (including DuPho where applicable) govern all agreements.

• Bookings are accepted only from individuals aged 18 or older. The photographer reserves the right to request valid identification on the day of the shoot. If the client is under 18, the shoot will be immediately cancelled without refund of any deposit or payments made.

2. Booking, Payment, and Cancellation

• Submitting a booking form is a non-binding request and does not create a binding agreement.

• A booking becomes final only upon receipt of a non-refundable deposit of 50%.

• The remaining balance must be paid in full before post-processing or delivery begins (in line with DuPho payment rules).

• Cancellation by client within 48 hours of the scheduled shoot: the deposit is forfeited. For earlier cancellations, costs for work already performed (e.g., scouting, location fees) may apply.

• Cancellation by photographer: full refund of the deposit; no further compensation is owed.

• Premium Location Fee (service fee + scouting hours): non-refundable once preparations have started, as it covers work already carried out.

3. Punctuality, Accompaniment, and Location Costs

• If the client arrives late, lost time is deducted from the shoot duration with no discount or extension.

• One support person (accompaniment) is permitted, provided they do not interfere with the creative process.

• Making (professional) photo or video recordings during the shoot—of the process or the photographer—is prohibited without explicit permission.

• All additional third-party costs (parking, entrance fees, extra travel expenses, etc.) are the client's responsibility.

4. Smoke Machine, Props, and Location Coordination

• Use of a smoke machine or haze requires written permission from the location owner; the photographer arranges this only if the Premium Location Fee is paid.

• The client is fully responsible for the legality, safety, and proper transport of any brought props and replica (non-real) weapons.

• Participation in the shoot is entirely at the client's own risk (supplemented by DuPho liability limitations).

5. Artistic Freedom, Selection, and Right of Refusal

• The photographer has full artistic freedom in styling, posing, and post-processing. Artistic choices are not grounds for complaints or refunds.

• The photographer may refuse concepts that do not align with their artistic vision or personal values, including (but not limited to) political, religious, or activist-related requests.

• If the client deviates during the shoot to unagreed political statements or inappropriate expressions, the photographer may immediately terminate the session without refund.

6. Delivery and Deadlines

• Final edited photos are delivered only after full payment has been received.

• Latest delivery deadline: 30 days after full payment is received by the photographer.

• Only edited JPG files are provided; the client is responsible for backups after delivery (RAW files are not delivered unless separately agreed).

7. Copyright, Integrity, AI Restrictions, and Publication

• Copyright on all works remains with the photographer at all times (as per DuPho copyright provisions).

• Every publication (online or print) must clearly credit the photographer: @IgnisInfinity_Creative.

• The client may not edit the delivered photos themselves or apply filters (including Instagram filters, Lightroom presets, etc.).

• AI Clause: It is strictly prohibited to use the delivered photos for training AI models (Generative AI) or generating AI edits/content without the photographer’s explicit written permission.

• Commercial use (merchandise, advertisements, resale of prints by third parties): requires a separate Commercial Upgrade licence (€50–€500+ depending on scope; supplemented by DuPho licensing rules).

• No use is permitted until all invoices are paid in full.

8. Privacy, Portrait Rights, and Final Provisions

• The client grants permission for the photographer to use the photos in their portfolio, website, and social media, unless a Private Shoot is explicitly agreed upon (at an additional fee), in which case the photographer refrains from publication.

• Applicable law: exclusively Dutch law. Disputes are handled as much as possible under DuPho dispute resolution procedures, otherwise by the competent Dutch court.

• If any provision is invalid or voidable, the remaining provisions remain fully in effect (salvage clause, standard in DuPho).
